American rapper, Dr. Dre, has lost a legal battle to an actual doctor named Dr. Drai. Dr. Draion M. Burch, an OBGYN based in Pennsylvania, tried to trademark his name back in 2015 as ‘Dr. Drai’. However, his motion was blocked by Dr. Dre, who claimed that the gynecologist would cause ‘confusion’ through a ‘suggested connection’.
Drai fought back claiming that Dre’s claims are baseless because Dr. Dre’s reputation is of no use to his career. Furthermore, Drai is Burch’s actual name and he is actually a doctor.
Here are his words:
‘It is not likely that consumers will recognize Applicant’s Dr. Drai’s marks as referring to Dr. Dre because Dr. Dre is not a medical doctor nor is he qualified to provide any type of medical services or sell products specifically in the medical or healthcare industry. Being an OB-GYN, I cannot be associated with anyone that has any kind of misogynistic speech because it’s a bad reflection on me as a doctor…That’s my name.’
Consequently, the court ruled in Dr. Drai’s favour by dismissing Dr. Dre’s opposing claim. Here’s the official ruling:
‘[The opposition cases] are dismissed on the likelihood of confusion and false suggestion of a connection grounds.’
